**Foreigners who do not reside in Korea, i.e., who have not reported their residence, can establish a corporation in Korea.  한국에 거주하지 않는 외국인, 즉 거주신고를 하지 않은 외국인도 한국에서 법인을 설립할 수 있습니다.​

As a representative, a business registration certificate is not issued. - Please call in advance to confirm.  대표자로서 사업자등록증은 발급되지 않습니다. - 사전에 전화로 확인 부탁드립니다.

* If a foreigner must be the representative, a foreign investment corporation must be established and the foreign investment must be at least 100 million won (approximately 80,000 US dollars).

* 외국인이 대표자가 되어야 하는 경우에는 외국인투자법인을 설립하고 외국인투자금액이 1억원 이상이어야 합니다.

You can report it to a foreign exchange bank, and general banks such as Korea Exchange Bank handle it.

외국환은행에 신고하시면 되고, 한국외환은행 등 일반은행에서 처리합니다.

2. Foreign currency transfer for the company establishment  회사설립을 위한 외화송금

- Remittance in the name of the investor from overseas after reporting the investment - You can remit to the virtual account.   - 해외에서 투자자 명의로 투자신고 후 송금 - 가상계좌로 송금 가능합니다.

3. Request for stock payment (balance proof can be substituted for establishment with an erection of less than 1 billion won)  10억원 미만설립시 잔액증명서로 대체합니다.

4. In corporation

​Documents are different depending on whether the foreigner taking office is in Korea.  취임하는 외국인이 국내에 있는지 여부에 따라 서류가 다릅니다.

If the inaugurated executive is in Korea, he or she can visit with a residence permit and passport  취임한 임원이 한국에 있는 경우 체류허가증과 여권을 지참하고 방문할 수 있다

If you are not in Korea, you must send documents other than the inauguration letter abroad, get them signed, notarized, translated and submitted.  한국에 있지 않은 경우에는 취임할때 필요한 서류를 해외로 송부하여 서명, 공증, 번역하여 제출해야 합니다.

5. Business registration- If you ask a tax accountant, you can act as an agent. In some cases, you may have to apply for registration in person if a foreigner is the representative. It varies a bit depending on the region.

 사업자등록 - 세무사에게 의뢰하시면 대리 가능합니다. 경우에 따라 외국인이 대표인 경우 직접 등록을 신청해야 할 수도 있습니다. 지역에 따라 조금씩 다릅니다.

6. Foreign-invested company registration - proxy service is available.  외국인투자기업 등록 - 대행 가능합니다.

7. Foreign investment visa application - We do not act as an agent.

After the foreign-invested company registration is completed, the foreign investor can apply for an investment visa in Korea.

In order to apply for a visa, you must be listed as an executive in the certified copy of the register, so investors who want to participate only as shareholders

외국인투자기업 등록이 완료되면 한국에서 투자사증을 신청할 수 있습니다.

비자를 신청하기 위해서는 등기부 등본에 임원으로 등재되어 있어야 하므로 주주로만 참여하고자 하는 투자자는

Important!!! Required documents for foreigner (Chinese) incorporation in Korea   외국인(중국인) 국내법인 설립 시 구비서류

To act as an agent, the following documents (power of attorney) are required.   대리인이 되기 위해서는 다음의 서류(위임장)가 필요합니다.

​

-There are many cases when establishing a corporation by a foreigner, so please read it carefully.

- 외국인이 법인을 설립하는 경우가 많으니 꼭 읽어보시기 바랍니다.

1. In case of participating only as a shareholder - Copy of passport, document proving address (copy)

주주로만 참가하는 경우 - 여권사본, 주소지 증명서류(사본)

2. In case of inauguration as an executive (CEO, executive director, auditor)  임원(대표이사, 상임이사, 감사)으로 취임하는 경우

Documents are completely different depending on the case of staying in Korea and reporting the residence and the case of not.

한국에 체류하면서 거소신고를 한 경우와 그렇지 않은 경우에 따라 서류가 완전히 다릅니다.

*If you have a residence visa and reported your place of residence  거주비자를 소지하고 거주지를 신고한 경우

- 1 copy of certificate of residence 주민등록등본 1부

- 1 copy of seal certificate (You can register your seal if you report your residence.) - If you do not have a seal, visit the office and have your signature notarized  인감증명서 1부 (거소신고 시 인감등록 가능) - 인감이 없을 경우 사무실 방문 서명공증

*If you do not have a residence visa and have not reported your residence

[1] There is a seal system in the country, and you do not stay in Korea

① 3 copies of the seal impression certificate printed in the country

② 3 copies of documents similar to the copy of resident registration printed in the country

※ If there is a seal system, there is a system similar to the resident registration system.

③ 3 copies of passport

④ A translation of the above '①' and '②' into Korean (there are no restrictions on the format)

⑤ Seal on the inauguration acceptance letter

*거주비자가 없고 거주신고를 하지 않은 경우

[1] 국내에 인감 제도가 있어 한국에 머물지 않는다.

① 국내에서 인쇄한 인감증명서 3부

② 국내에서 인쇄된 주민등록등본과 유사한 서류 3부

※ 인감제도가 있으면 주민등록제도와 유사한 제도가 있습니다.

③ 여권사본 3부

④ 위 '①', '②'를 한글로 번역(형식 제한 없음)

⑤ 취임승낙서에 날인

중국의 경우는 중국내 한국영사관의 인증이 꼭 필요합니다.
